Rep. Alexandria Ocasio-Cortez, D-N.Y., is currently facing a federal investigation for allegedly hiring an undocumented immigrant for her congressional staff and for organizing events that purportedly helped illegal immigrants evade federal immigration enforcement, as reported by Border Czar Tom Homan and the Gateway Pundit.

Homan disclosed this information during an interview on the Benny Johnson Show on Monday, confirming that two distinct allegations against the New York Democrat are now being examined.

“It’s being looked at,” Homan stated when questioned about Ocasio-Cortez’s alleged employment of an undocumented immigrant. “Can’t comment past that. I’m aware of it. We’ve asked ICE to drill in on that case.”

The individual involved, Diego de la Vega, previously held the position of deputy communications director in Ocasio-Cortez’s congressional office and was also engaged in her 2021 campaign.

According to The Gateway Pundit, de la Vega self-deported to Colombia in December 2024, shortly after President Donald Trump secured the 2024 presidential election.

In addition to the employment matter, Homan indicated that Ocasio-Cortez may have violated legal statutes by conducting webinars aimed at instructing illegal aliens on how to avoid detection or arrest by Immigration and Customs Enforcement (ICE) agents.

“She’s really educating them on how to avoid prosecution,” Homan remarked.

“Because there are statutes on the books when you knowingly hinder your removal—that’s a crime. We have instructed ICE to start prosecuting these cases.”

 

In a previous interview on Fox News’ The Ingraham Angle in February, Homan disclosed that he had reached out to the Deputy Attorney General’s office to request a formal examination of Ocasio-Cortez’s conduct.

“At what level does that obstruction occur?” Homan remarked at that time. “I’m not a lawyer… Is that obstructing our law enforcement efforts? If it is, what actions will we take? Is she overstepping her bounds?”

Ocasio-Cortez has not made any public comments regarding the investigation. In a previous statement to Migrant Insider concerning de la Vega’s exit, she remarked, “Diego is incredible. We appreciate him.”

The Trump administration has prioritized immigration enforcement, and under his guidance, border crossings have reached the lowest levels seen in a generation.
